APCO's 2010 License
APCO's 2010 FERC license became effective on 1 April 2010. A copy of the license and the FERC order issuing the license is attached below. Also attached is APCO's certification which claims the following:

1. LICENSEE HAS OBTAINED ALL FLOWAGE RIGHTS NECESSARY
FOR ADEQUATE OPERATION OF THE PROJECT EITHER IN FEE
TITLE OR EASEMENTS. ALL PROPERTY RECORDS ARE KEPT
ON FILE WITH THE LICENSEE.
2. THE PROJECT BOUNDARY SHOWN IS AT EL. 620' AROUND
THE LEESVILLE DEVELOPMENT AND EL. 800', AROUND THE
SMITH MOUNTAIN DEVELOPMENT UNLESS OTHERWISE SHOWN
AS METES AND BOUNDS LISTED ON INDIVIDUAL SHEETS.
3. REFERENCE POINT COORDINATE PAIRS ARE SHOWN IN THE
VIRGINIA STATE PLANE COORDINATE SYSTEM, NORTH AMERICAN
DATUM OF 1983 WITH UNITS IN FEET.
4. THIS MAPPING IS BASED ON THE NAD83 VIRGINIA SOUTH STATE
PLANE COORDINATE SYSTEM. ALL ELEVATIONS ARE SHOWN USING
THE NGVD OF 1929. PROJECT BOUNDARY DATA COMPILED FROM
AERIAL TOPOGRAPHIC SURVEY (1 2/10/2005) AND REAL ESTATE
SITE PLANS ON FILE WITH THE LICENSEE (VARIOUS YEARS).
APCO's claims that it holds "all flowage rights necessary" is a lie. The 2010 federal license cannot change your property rights were were obtained in 1960 and documented in your property deed and appurtenant flowage easement.
